The personal data of migrants and national security in Mexico. A legislative dilemma between the political and the ethical

Abstract

In this paper we address a particular topic of human mobility: the protection of personal data. In this case, our objective is to study the relationship between the protection of personal data and migration in Mexico, for this, we focus on regular and irregular migration, mainly from Central America that transits through Mexico to the United States. We analyze the management and use of personal data of migrants from national security, since, in Mexico, the National Institute of Migration as a National Security Instance, is in charge of executing the migration policy and, therefore, the storage of personal data and information, in this case, of foreigners who regularly and irregularly enter Mexican territory. We then carried out a study at the legislative level on this protection that should be given to the personal data of migrants entering Mexico.
